Terms of Service

1. Agreement
These Terms of Service govern your use of insruteam.com (the "Service") operated by Insurteam AG ("the Company," "we," "us," or "our"), 21 Bahnhofstrasse, Zurich 8001, Switzerland. By using the Service you accept these Terms. If you do not accept them, do not use the Service.
The Service is a business-to-business claims-automation tooling platform. It is designed for travel insurers and their claims teams. Insurteam AG is not a licensed insurer, carrier, broker, or underwriter. The Company provides software tooling that assists insurer clients with FNOL intake, policy clause extraction, loss verification, and parametric settlement decisions. Final coverage, settlement, and payment authority remain with the insurer client. Nothing in the Service constitutes insurance advice, underwriting, or a binding coverage determination.
If you are a consumer (a natural person acting outside your trade, business, craft, or profession), nothing in these Terms limits your statutory consumer rights under your country of residence.
2. Use of the Service
- You must be at least 18 years old or have parental consent to use the Service.
- You agree not to use the Service for unlawful purposes, to interfere with its operation, or to attempt unauthorised access to any part of the platform or its infrastructure.
- You may not copy, scrape, reverse-engineer, or decompile the Service except as permitted by mandatory Swiss law or the terms of a separate written agreement with the Company.
- Insurer clients accessing the platform through a subscription agreement are additionally bound by the terms of that agreement, which supplements these Terms of Service.
3. Intellectual Property
The Service, including all software, algorithms, LLM pipeline architecture, documentation, and website content, is owned by Insurteam AG or its licensors and is protected by Swiss and international intellectual-property law. You receive a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose as a claims-automation tool for travel insurance processing. No other rights are granted.
4. User Content and Data
You are responsible for any content and data you submit to the Service, including insurance policy documents, FNOL records, and supporting claim evidence. You represent that you have the necessary rights to submit such data and that doing so does not violate any law or third-party rights. You grant the Company a limited licence to use, store, and process submitted content solely to provide the contracted claims-automation Service. The Company does not claim ownership of your submitted data and does not use it to train machine learning models without your explicit written consent.
5. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid contract with the Company as a consumer at distance, you have the right to withdraw within 14 days under applicable consumer protection law without giving any reason. To exercise the right, contact [email protected] with a clear statement of withdrawal. The Company will refund all payments received within 14 days of receiving the withdrawal notice.
The Service as currently offered through insruteam.com is a B2B platform; direct paid digital-content subscriptions for consumers are not presently offered through this website. This clause applies only if and when such paid consumer services are offered.
6. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" basis. The Company's pipeline outputs are computational recommendations that assist insurer claims teams; they are not legally binding coverage or settlement decisions. Insurers remain responsible for all final claim determinations. Nothing in these Terms excludes or limits the Company's liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory Swiss law. Statutory guarantees that apply to consumers are not affected.
7. Limitation of Liability
To the extent permitted by Swiss law, Insurteam AG's total liability for any claim arising from or related to the Service will not exceed CHF 100, except for liability that cannot be limited under mandatory law (see Section 6). This limitation applies whether the claim arises in contract, tort, or otherwise, and whether or not the Company has been advised of the possibility of such loss.
8. Termination
The Company may suspend or terminate your access for breach of these Terms. Sections 3, 6, 7, 9, and 10 survive termination by their nature.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules.
The courts of Zurich, Switzerland have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service, subject to mandatory consumer-protection rules of your country of residence. If you are a consumer, you may also bring proceedings before the courts of your country of residence, and the Company may sue you only in those courts.
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. The Company does not commit to using this platform but will cooperate where required by applicable law.
10. Changes
The Company may update these Terms. Material changes are posted with a revised "Effective" date. Continued use of the Service after the effective date of an updated version constitutes acceptance of the revised Terms.
